In the never-ending development of criminal law, based upon the never-ending development of technology, a new wrinkle has occurred.

Thanks to the Florida legislature, effective July 1, 2015, a drone is not allowed to be used in law-enforcement to spy on alleged criminal activity — without first obtaining a warrant. This is remarkable legislation, as usually it is up to the courts to preserve individual rights.

Based upon this new legislation, lawyers will soon be inquiring of law-enforcement how probable cause was developed for warrants and arrests.  There will be arguments with the prosecution regarding information and evidence obtained contrary to this law.
